Terms of Use for LINE customer support
This document is made in Japanese and translated into English for reference purposes only. In the event of any discrepancy between the Japanese and English versions, the Japanese version shall prevail.
Woodstock K.K. (hereinafter referred to as the "Company") establishes the following Terms of Use (hereinafter referred to as the "Terms") regarding the use of the inquiry response service that utilizes the LINE official account provided by the Company (hereinafter referred to as the "Service") through the communication application "LINE" (hereinafter referred to as "LINE") provided by LINE Yahoo Japan Corporation.
Article 1 (General Provisions)
- These Terms shall apply to all persons who use the Service (hereinafter referred to as "Users").
- By using the Service, Users shall be deemed to have agreed to all provisions of these Terms.
- When using the Service, Users shall comply with the various terms and conditions established by LINE Yahoo Japan Corporation.
- When making inquiries through the Service, Users shall not send or include personal information or images, videos, etc. containing personal information.
- Users shall use the Service on the understanding that the Company is a Financial Instruments Intermediary Business as defined in Article 66 of the Financial Instruments and Exchange Act and does not provide investment advice as prescribed in said Act through the Service.
Article 2 (Service Content and Usage Environment)
- The Service is a service through which the Company responds in text, etc. to inquiries made by Users via text, etc. using the functions of LINE.
- Users shall install and configure LINE on their own communication devices at their own responsibility and expense, maintain an appropriate usage environment for the configuration and use of LINE, and bear all communication costs and other expenses related to the use of the Service.
- The Company shall not be liable for any damages arising from the User's failure to install and configure LINE or maintain an appropriate usage environment for the configuration and use of LINE as set forth in the preceding paragraph.
- The Service is intended for use by residents of Japan, and the Company shall not be liable for any damages arising from use outside Japan.
Article 3 (Service Hours and Operation)
- The Service reception and response hours shall, in principle, be from 10:00 a.m. to 5:00 p.m. on the Company's business days.
- The Company's business days as set forth in the preceding paragraph shall be days excluding Saturdays, Sundays, national holidays, public holidays, and the New Year holiday period. The New Year holiday period shall be separately announced on the U.S. stock trading application (hereinafter referred to as "Woodstock") provided by the Company or on the Company's website.
- Notwithstanding the provisions of paragraph 1, the Service does not guarantee immediate responses, and responses may take time or may be withheld depending on the volume of inquiries, the content of inquiries, or other factors.
- The Company may deliver information regarding the Company's services, etc. within the Service based on information transmitted by Users through the Service, and Users shall consent to this in advance.
Article 4 (Scope of and Limitations on Inquiries)
- Matters eligible for responses through the Service shall be limited to matters related to the Financial Instruments Intermediary Business conducted through Woodstock. However, inquiries for which the Company obtains the User's personal information and requires customer identification shall not be responded to through the Service.
- Notwithstanding the preceding paragraph, the Company shall decline to respond to inquiries set forth in the following items:
(1) Matters concerning the history of inquiries made through the Service that the Company determines have already been fully responded to
(2) Matters that the Company determines are appropriate to respond to by email, telephone, or other means
(3) Matters that constitute investment decisions, advice, or recommendations regarding investment decisions such as the timing of trading, selection of securities, market trends, etc.
(4) Matters concerning account opening screening criteria, details of screening results, or internal systems
(5) Technical operating methods for the User's terminal devices, OS, other software, etc.
(6) Matters that the Company determines it should refrain from responding to due to laws, regulations, or restrictions, orders, etc. from regulatory authorities
(7) In addition to the preceding items, matters that the Company determines are inappropriate for response through the Service
- If the Company deems it necessary in providing a response, the Company may separately request identity verification from the User by a method specified by the Company.
- If the Company deems it necessary in providing a response, the Company may respond to the User by means other than the Service.
Article 5 (Suspension of Responses and Discontinuation of Use)
The Company may, without obtaining the User's consent, suspend responses or discontinue the provision of the Service (including blocking measures, etc.) if the User falls under any of the following items:
(1) If the input content is illegible or the User repeatedly makes inquiries with the same content
(2) If defamation, harassment, libel, or other inappropriate speech or conduct is recognized toward the Company, its affiliated Financial Instruments Business Operator and their officers and employees, or any third party
(3) If there is an act that causes or may cause disadvantage or damage to the Company, its affiliated Financial Instruments Business Operator and their officers and employees, or any third party
(4) If there is an act that infringes or may infringe the intellectual property rights, copyrights, etc. of the Company, its affiliated Financial Instruments Business Operator and their officers and employees, or any third party
(5) If election campaigns, political activities, religious activities, business activities, or similar acts are recognized
(6) If impersonation of another person is recognized
(7) If the act violates or may violate laws, regulations, or public order and morals
(8) If there is or may be the posting of harmful computer programs, etc.
(9) If images, videos, stickers, advertisements, promotional links, etc. unrelated to the Company's services, including the Service, are transmitted or included
(10) If there is no response for a certain period of time, or if the Company cannot confirm receipt of a response
(11) If the User does not comply with identity verification for inquiries that require identity verification
(12) If the Company determines that retaining the inquiry history is inappropriate, such as when personal information unnecessary for responding to the inquiry is included
(13) In other cases where the Company determines that the matter is unrelated to the purpose of the Service or would interfere with the operation of the Service
Article 6 (Handling of User Information)
- The Company shall appropriately manage User information obtained in connection with the use of the Service in accordance with the Company's Privacy Policy.
- The Company may discard or delete the User information and usage history it holds at any time at its discretion.
Article 7 (Ownership of Rights)
- Users shall grant to the Company a worldwide, royalty-free, non-exclusive right to use (including reproduction, modification, public display, translation, etc.) content such as images, videos, text, etc. transmitted through the Service (hereinafter referred to as "Content"), and shall not exercise copyright, moral rights, or other intellectual property rights with respect to such Content.
- The copyright and all other intellectual property rights (including copyrights, design rights, patent rights, utility model rights, trademark rights, etc.) in the information provided through the Service belong to the Company or the rightful rights holders. Users may not use such information beyond the scope of private copying without the consent of the rights holder. Any commercial use is strictly prohibited.
Article 8 (Disclaimer of Liability)
- The Company makes no warranties whatsoever regarding the functionality, safety, reliability, confidentiality, etc. of LINE, and shall not be liable for any damages arising from these.
- Notwithstanding the Company's warning to Users not to input personal information or send or include images, videos, etc. containing personal information when using the Service, the Company shall not be liable for any leakage of personal information resulting from a User voluntarily sending or including such information.
- The Company may terminate, suspend, or change the content of the Service without prior notice. The Company may also modify or delete content published on the Service without the User's consent, and the Company shall not be liable for any damages incurred by the User as a result thereof.
- The Company shall not be liable for any damages arising from errors, omissions, etc. in information transmitted by the Company.
- If a User causes trouble or disputes with other Users or third parties in connection with the use of the Service, the User shall resolve such matters at their own responsibility and expense, and the Company shall not be liable in any way.
- The Company shall not be liable for any damages arising from malfunction of the User's communication devices, inadequate password management, or similar causes.
- If the provision of the Service is delayed or becomes impossible due to reasons attributable to third parties other than the Company or due to force majeure such as natural disasters, conflicts, etc., the Company shall not be liable for any damages arising therefrom.
- The Company shall not be liable for any damages arising from leakage, etc. of the User's personal information due to eavesdropping, etc. over communication paths such as public telephone lines, dedicated telephone lines, the Internet, or other communication lines, or due to vulnerabilities in LINE.
- Notwithstanding the foregoing, the Company shall not be liable for any and all damages arising to Users or third parties in connection with the Service.
Article 9 (Damages)
- The Company shall not bear any liability for all damages incurred by Users arising from the Service, and shall have no obligation to compensate for such damages.
- If a User causes damage to a third party through the use of the Service, the User shall resolve the matter at their own responsibility and expense and shall ensure that the Company does not suffer any damage.
- If a User violates these Terms or causes damage to the Company through fraudulent or illegal acts, the Company may claim reasonable damages from such User.
Article 10 (Amendment of Terms)
The Company may amend these Terms at any time. The amended Terms shall become effective from the time they are published on the Company's website or announced by other appropriate means.
Article 11 (Governing Law and Agreed Jurisdiction)
- The interpretation and application of these Terms shall be governed by the laws of Japan.
- In the event of a dispute between the User and the Company regarding the Service, the local district court having jurisdiction over the location of the Company's headquarters shall be the exclusive agreed court of jurisdiction for the first instance.
