Feds seek lower prison term for $100 million New Jersey deli fraudster — but some reasons why are hidden
Federal prosecutors are asking for a sharply reduced prison sentence for James Patten in the New Jersey deli stock-manipulation case, even though he pleaded guilty to securities fraud. In a new court filing, the government urged U.S. District Judge Christine O’Hearn to sentence Patten to 12 to 18 months in prison.
That recommendation sits well below the advisory sentencing range set out in the same filing. Prosecutors told the court the guidelines suggest 70 to 87 months, meaning the sentence they want is measured in years below the range they say applies.
Patten, 65, is scheduled to be sentenced in Camden on July 21. He has remained free while awaiting sentencing since pleading guilty in late 2023, and he is the third person due to be sentenced in the scheme.
The unusual feature of the filing is not only the degree of leniency the government is seeking, but that the public record does not reveal all of the reasons behind it.
The filing makes clear that prosecutors are relying at least in part on reasoning that is not publicly disclosed, leaving outside readers with only a partial view of why they believe a much shorter prison term is appropriate.
That missing information matters because sentencing recommendations in market-manipulation cases are often read as signals about how prosecutors weigh deterrence, culpability and cooperation. Here, the public can see the government’s request and the guideline calculation, but not the full basis for reconciling the two.
A judge is not bound by either the government’s recommendation or the advisory guideline range.
The case itself drew attention because it involved Hometown International, a company that owned a single deli yet at one point was associated with a market valuation of roughly $100 million.
That disconnect made the matter an unusually vivid example of the risks and distortions that can emerge in thinly traded microcap stocks, where market values can become detached from the scale of the underlying business.
Because the government’s rationale is only partly visible, the filing offers an incomplete public roadmap for interpreting enforcement priorities in a case with clear market-manipulation overtones.
Investors, lawyers and compliance professionals can plainly see that prosecutors are seeking a sentence far below the advisory range, but they cannot fully judge from the public record which factors drove that position or how much weight the court may give them.
That leaves the July 21 sentencing as the next key point of clarity in a case where the headline numbers are public, but part of the explanation is not.
